Beale found not guilty by tribunal

KURTLEY Beale has been found not guilty of code of conduct breaches by an independent tribunal, but was fined $40,000 by the ARU.

Beale and his representatives were locked away for four hours pleading their case to the three-man panel comprised of District Court judge Mark Williams SC, former Wallaby David Giffin and barrister Dominic Villa.

The hearing into his alleged sending of lewd texts and offensive images to teammates and inadvertently to former Wallabies business and logistics manager Di Patston started at ARU headquarters in Sydney soon after Beale arrived around 5pm.

The Wallabies left earlier Friday for the spring tour of Europe.

Beale will make a 70-page submission to the hearing and has ­requested that both former coach Ewen McKenzie and Patston are present for cross examination. Neither are expected to attend.

His legal team is expected to argue Beale should be allowed to join the Wallabies’ spring tour and be paid compensation for his considerable legal bills.

Beale’s past record can be taken into account if a penalty is required.

The last Wallaby to face a code of conduct hearing was Quade Cooper in 2012 over the infamous “toxic” outburst, and social media criticism of an ARU-endorsed video game.

He was fined $40,000 and hit with a suspended three-match suspension.
